Terms and Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the website claudiamachado.me  (the “Services/Products”) operated by Claudia Machado (“me”).

Your access to and use of the Service/Products is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Services/Products.

If you disagree with any part of the Terms, you may not access the Services/Products.

Offers and prices
This site offers digital services and products. Some prices for these services and digital products can be found listed on the site. This price does not include taxes or other fees that may be charged. We reserve the right to modify, change, cancel, or update a subscription and/or license key without prior notice or consent. Prices for all products/services are subject to change without notice or consent.

Personalized services (quotes/proposals)
The Client must provide access to the information and elements required in good time for the proper execution of the Project.

I must carry out the work entrusted to me and the obligations generated by the nature of the project with efficiency and punctuality.

I cannot guarantee that the completed Project will be completely error-free, and therefore cannot be held liable to the Client or Third Parties for damages, including lost profits or other incidental, consequential, or special damages, even with prior notice.

The Client is responsible for overseeing the progress of the Project and providing any necessary feedback. Once the Client has confirmed the completion of the Project, no further modifications will be accepted. Should the Client request changes after confirming the Project’s completion, additional fees will apply accordingly.

The Client will have a maximum of 2 (two) days from the time our email is sent to confirm whether the Project has been completed. If the Project is not complete, revisions will be made in line with the agreed-upon proposal. If no response is received within 2 (two) days, the Project will be considered finalized.

Design services are delivered to the Client in a final file format. If the Client requires an editable file, an additional fee will be applied based on the scope of the service provided.

After delivering the completed projects to the Client, I reserve the right to showcase them on my website, including in my portfolio, case studies, social media, and/or on websites or blogs used to promote my work.

By default, website design/redesign and development projects include free themes and plugins available in the WordPress repository. If it is determined that a feature requiring paid (premium) themes or plugins needs to be implemented in the project, the costs associated with their purchase or subscription will be the responsibility of the Client.

Once the design/redesign and development of the website hosted on the Client’s own server is completed, the Client will receive access to the WordPress Backoffice (Admin Panel) and will assume full responsibility for the website. Therefore, I am exempt from any responsibility after the delivery of the website design/redesign and development project.

Accepted proposals that include hosting on our server, a security certificate, and an email account are valid for 1 year from the website’s publication date. After this period, the Client will need to pay a fee of €85 annually to continue using the hosting, security certificate, and email account for an additional year.

During the period in which the website is hosted on our server, neither the Client nor any person designated by the Client will have access to the website’s back office as the site Administrator.

Before the end of each year of the plan, I will contact the Client to inform them that the period is ending. If the Client chooses not to pay the €85 fee, the website will automatically go offline. However, the Client may request a backup of the site at no cost within 7 days after the 1 year, allowing them to migrate the site to another hosting service.

Website Maintenance
By selecting a website maintenance plan, you agree to pay the indicated annual subscription fees (additional payment terms may be specified in other communications). Subscription payments will be charged on a pre-payment basis on the day you enroll in the plan and will cover the use of the service for the specified annual subscription period. Payments are non-refundable.

Your subscription will be automatically renewed unless you notify us by email of your intention to cancel before the end of the applicable subscription period. The applicable annual subscription fee (and any applicable taxes) will be charged using the credit card or other payment method we have on file for you. Subscriptions can be canceled at any time by contacting us at webdesign@claudiamachado.me, to request cancellation.

During the term of a Website Maintenance Plan, the Client or any person designated by the Client will not have access to the back office (Admin Panel) of the site as the site Administrator.

Site Express/Low Coast
The cost of this service does not include a domain name. If you do not have a domain name, you will need to register and purchase one before the development of the site begins. If you already have a domain name, I may need credentials for your domain name service provider to point the domain to the appropriate DNS records when the site is launched. If the domain is already pointing to an existing site that I will be replacing, this step may not be necessary.

The theme installation, hosting, security certificate, and email account are valid for 1 year from the date of package purchase. The Client will need to pay an annual fee of €85 at the end of each year to continue using the theme, hosting, security certificate, and email account for an additional year.

During the term of a Site Express Package subscription, the Client or any person designated by the Client will not have access to the site’s Backoffice as the site Administrator.

Before the end of each year of the plan, I will contact the Client to inform them that the subscription period is ending. If the Client chooses not to pay the €85 fee, the website will automatically go offline. However, the Client may request a backup of the site at no cost within 7 days after the 1-year period expires, allowing them to transfer the site to another hosting provider.

The installation of plugins is limited to free plugins available in the WordPress repository, unless the Client provides a valid license for a PREMIUM (paid) plugin. Installation of pirated plugins is not permitted.

Divi Layouts and Modules
To access Divi Layouts and Modules, it is necessary to have the Divi Theme. After payment, the Client will receive an email with a link to access the materials.

Payment

The following payment methods are accepted by the third party payment service: PayPal, MBWAY, or Bank Transfer.
I am not responsible for the collection, use, sharing, or security of your billing information by the third-party payment service.

You represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information you provide to me and the third-party payment service(s) is true, correct, and complete.

Special Offers
All special offers and coupon codes must be redeemed at the time of purchasing the product or contracting the service.

Cancellation policy
There is no possibility of canceling any purchases you have made of services and/or digital products offered on this website.

I reserve the right to cancel your purchase for any reason in my sole discretion, including but not limited to fraud, inaccuracies, and unavailability of the items or services purchased. No notice will be provided before canceling your purchase. In this case, a refund of the full purchase price you paid will be issued if we cancel your purchase.

Refund policy for digital products (ebooks | layouts)
I have full confidence in the products offered on this site, but I understand that they may not perform perfectly in all situations. We offer refunds for purchases of digital products made through our website. To be eligible for a refund, you must submit your request within 14 days of the purchase date by contacting us via email, including the details of your order and a valid reason for the refund.

The offering of refunds is subject to my sole discretion for any purchases of digital products offered on the site only for the following reasons: the product did not meet the guarantees (if any), and incorrect description.

Please note that I do not offer refunds for any reasons other than those listed above.

Use of stock images
Some images used in the product demonstrations are copyrighted by their respective owners and are subject to limited use. You do not have the rights to reuse the images in their current or original formats without a license from the owner. I use these images for demonstration purposes only, and the product you purchase may contain placeholder images instead of any copyrighted material.

Subscriptions
This site offers products or services through a subscription model. A subscription model requires upfront payment in full to receive a product or service. The initial subscription term is 1 year.
You may cancel your subscription immediately after purchase; however, no refund will be issued for the amount paid.

Links to other sites
This website may contain links to third-party sites or services that are not owned or controlled by me.

I have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You also acknowledge and agree that I will not be liable, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such sites or services

I strongly recommend that you read the terms and conditions and privacy policies of any third-party sites or services that you visit.

Applicable law
These Terms will be governed by and interpreted in accordance with the laws of Portugal, which shall be the only applicable jurisdiction.

In the absence of an amicable agreement between the parties, the jurisdiction for resolving any disputes shall be assigned to the competent Portuguese courts. In case of dispute, the consumer may resort to a Consumer Dispute Resolution Entity. For more information, please consult the Consumer Portal at www.consumidor.pt.

My failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between Claudia Machado regarding the Services/Products and supersede any prior agreements you may have had with me about them.

Changes
I reserve the right to make changes to these Terms at any time. No notice will be provided when changes are made to these Terms.
